Introduction:

This agreement (“Agreement”) is entered into by and between Office Analytica GmbH, a company registered in Germany with its registered address at Brüder-Grimm-Straße 6, 34596 Bad Zwesten, Germany (“Company”), and the user (“User”) downloading, installing, or using the Office Analytica Outlook Plugin (Beta Version) (“Plugin”).

By downloading and installing the Plugin, the User implies their acceptance of these Terms of Use. If the User does not agree to these Terms of Use, they should not use the Plugin.

Description of the Plugin:

The Office Analytica Outlook Plugin (Beta Version) is designed to enhance email and office productivity within Microsoft Outlook. It offers the following functionalities:

  • AI Features: The Plugin provides AI capabilities to summarize incoming emails, generate positive or negative email replies, propose example emails, assist in email composition, enhance readability, improve grammar, and offer business formal writing. Custom commands are also available. These features are powered by the OpenAI API and ChatGPT. The User acknowledges that data may be shared with OpenAI for processing.
  • Email Meta-Information Capture: The Plugin captures and stores email meta-information, including EmailID, UserID, Sender Email (hashed), Subject (hashed), character and word counts, recipient counts, attachment details, external recipient information, workload calculations, conversation length, email status, send date and time, API UserID (hashed), DomainID, and PluginID. Data is securely stored on servers hosted by Strato AG in Germany.

User Accounts:

User accounts are automatically created upon installation of the Plugin. These include:

  • API User: Created for secure communication between the Plugin and Company servers. Passwords are hashed for security.
  • Dashboard User: Provides access to the dashboard using the email address used during Plugin installation. A first-time password is provided within the Plugin.

Token Usage:

The User is initially provided with 10,000 free tokens to access Plugin features. Additional tokens are available for purchase and are required for using AI functionalities. Token consumption is calculated based on text sent to and received from OpenAI. Organizational tokens are available for corporate clients.

Data Privacy and OpenAI:

The User is responsible for data shared with OpenAI when using AI functionalities. OpenAI’s Terms of Use apply to such data. The Plugin does not send personal data to OpenAI by default.

Data Storage and Retention:

User data, primarily email meta-information, is stored securely on servers hosted by Strato AG in Germany. Most user-related data are stored in encrypted (hashed) form. Users have the option to request the deletion of their accounts and data by contacting contact@office-analytica.com.

User Communication:

The Company currently lacks proactive communication regarding updates. Users can contact contact@office-analytica.com or support@office-analytica.com for support or inquiries.

License Grant:

The Company grants the User a non-exclusive, non-transferable, revocable license to download, install, and use the Office Analytica Outlook Plugin (Beta Version) solely for the purpose of testing and evaluation within Microsoft Outlook.

Use Restrictions:

The User agrees not to distribute, sublicense, modify, reverse engineer, or decompile the Plugin. The User shall use the Office Analytica Outlook Plugin (Beta Version) solely for its intended purpose and in compliance with all applicable laws and regulations.

No Warranty:

The User acknowledges that the Office Analytica Outlook Plugin (Beta Version) is provided “as is,” and the Company makes no warranties, express or implied, regarding the functionality, performance, or suitability of the Plugin. The User uses the Office Analytica Outlook Plugin (Beta Version) at their own risk.

Backup Responsibility:

The User is solely responsible for creating and maintaining adequate backups of all data within their Outlook application and connected Exchange servers, MAPI accounts, or any other components related to their Outlook installation. The Company assumes no responsibility for data loss or any adverse consequences arising from the use of the Office Analytica Outlook Plugin (Beta Version).

Termination:

Upon termination of this Agreement, the User shall immediately cease using the Office Analytica Outlook Plugin (Beta Version) and shall, at the Company’s request, uninstall and remove the Plugin from their systems.

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of Germany. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Germany.

Beta Version:

The Office Analytica Outlook Plugin (Beta Version) is a beta version, and the User acknowledges that the Company does not guarantee its performance, reliability, or suitability for any purpose.
